Inio Service Terms of Use

1. Introduction

The InSAR service known as Inio is provided by the Norwegian Geotechnical Institute (NGI) in collaboration with Kongsberg Satellite Services (KSAT). By accessing or using our service, you as a customer of the service agree to comply with and be bound by the following Terms of Use (ToU). Please read these terms carefully before using the service.

2. Service provided As-Is

NGI endeavors to provide the service to the best of its abilities but does not guarantee uninterrupted or error-free service, such as faulty or lack of available data due to satellite malfunction. The Inio InSAR online data tool is provided on an "as-is" basis. NGI makes no representations or warranties of any kind, express or implied, regarding the service's operation or the information, content, materials, or products included.

3. Customer Responsibility

The reports generated by the Inio service are provided for informational purposes only. It is the customer's responsibility to determine the suitability of the reports for their intended use. NGI shall not be liable for any decisions made or actions taken by the customer based on the reports.

4. License and Intellectual Property

Upon payment of the applicable fees, NGI grants the customer a limited, non-exclusive, non-transferable license to use the reports internally. This license does not confer any ownership rights to NGI's intellectual property. The customer may own the copy of the report and its data, but all intellectual property rights to Inio InSAR material and rights to the service remain with NGI. No underlying satellite imagery shall be provided to customer unless otherwise specifically agreed in writing.All rights, title, and interest in and to the Inio service, including but not limited to its material, design, features, functionality, software, and any associated intellectual property, are and will remain the exclusive property of NGI.Customers may provide feedback, suggestions, or ideas regarding the service ("Feedback"). By submitting Feedback, you agree that (i) NGI is free to use, disclose, reproduce, license, distribute, and exploit the Feedback as it sees fit, entirely without obligation or restriction of any kind, (ii) you will not receive any compensation or acknowledgment for the Feedback, and (iii) that the Feedback does not contain confidential or proprietary information of any third party.

5. Limitation of Liability

To the fullest extent permitted by law, NGI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the InSAR service. The customer's sole remedy in the event of dissatisfaction with the service is to terminate its use.

6. Termination

Unless otherwise agreed in writing between the parties, either party may terminate the service at any time. Upon termination, the customer's right to use the service and any reports generated will cease immediately. NGI shall not be required to carry out any further work upon termination. However, the customer remains liable for payment of all work completed and any reports generated up to the date of termination.

7. Confidentiality

The customer agrees to maintain the confidentiality of any proprietary information received through the service and not to disclose such information to any third party without NGI's prior written consent. The customer agrees to maintain the confidentiality of any proprietary information received through the service, including but not limited to pricing, methodologies, technical data, business strategies, and any other information related to the services provided by NGI. The customer shall not disclose such information to any third party without NGI's prior written consent. The obligation to maintain confidentiality extends to any information that is marked as confidential or that a reasonable person would understand to be confidential due to the nature of the information or the circumstances of its disclosure.Furthermore, the customer agrees to use the proprietary information solely for the purpose of utilizing the services provided by NGI and not for any other purpose. The customer shall take all reasonable measures to protect the confidentiality of the information, including implementing appropriate security measures and restricting access to authorized personnel only.This confidentiality obligation shall survive the termination of the service agreement and remain in effect for a period of five years following termination. The customer acknowledges that any breach of this confidentiality obligation may result in irreparable harm to NGI, and NGI shall be entitled to seek injunctive relief in addition to any other remedies available at law or in equity.

8. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law principles.

9. Amendments

NGI reserves the right to modify these Terms of Use at any time. Any changes will be effective immediately upon posting on the NGI website. Continued use of the service after any such changes constitutes acceptance of the new terms.

10. Security and Access Confidentiality

The security of your account and access to the Inio service is of utmost importance. The customer is responsible for maintaining the confidentiality of their login credentials and any other security information related to their account. You agree to (i) keep your login credentials confidential and not disclose them to any third party, (ii) notify NGI immediately of any unauthorized use of your account or any other breach of security, (iii) ensure that you exit from your account at the end of each session, and (iv) NGI will not be liable for any loss or damage arising from your failure to comply with these security obligations. You are solely responsible for all activities that occur under your account, whether or not authorized by you.
